Mediation Program
The CCM has a four-tier approach to enable mediation practice and strengthen mediation as peaceful dispute resolution mechanism in Cambodia:
1. Mediation Training
The program aims at developing and enabling mediation process and practice in the non-formal dispute settlement and the formal judicial justice system in Cambodia through providing training on specific mediation capacity to the local and national, non-government organizations (NGOs), private sectors, lawyers, ADR practitioners and government officers to apply dispute resolution and equips them with concepts and practical skills in conflict analysis, resolution and mediation techniques. The program trained the selected potential mediators to work as volunteer and being neutrals between conflict parties within their organizations, public institutes, government, and non-government structures. The program also provides training services on mediation to public and private institutions or organizations who require and need to develop and enhance conflict resolution and mediation mechanism to individuals, own institutions or organizations.
Furthermore, the program intends to engage university students through their capacity building to work with conflict and apply mediation practice to transform violent conflict into peaceful solution through dialogue. The program mainly targets students of law schools who will become Peer Mediators to help friends and families to solve their problem and dispute in daily lives. The program will support the students to apply mediation in society and to engage with community people.
In cooperation with the government, the program provides technical support to Justice Service Centres for Justice which is functioning of mediation services at 40 districts in the country. The program strengthens the capacity of district officers to effectively mediate disputes. The program also supports the policy makers to adapt the ADR into the judicial justice system in Cambodia.
2. The Development of Professional Mediators
The program certifies qualified mediators who are willing and able to provide standard and effective mediation service to the public institutes, communities and private sectors. The professional mediators are specially trained in specific skills on mediation, local dispute resolution, and legal assistance following the standard requirement of the centre. The professional mediators are recruited from ADR practitioners, religious leaders, teachers, lawyers, and retired people such as lawyers, legal experts, judges, and administrative officers and formed as neutrals or professional mediators once completed the CCM mediation standard requirement.
The certified mediators will be rendered disciplinary measures registered as CCM mediator committee. The qualified mediators have to fulfill requirements and rules to provide mediation services to the clients with agreement to the CCM principles. The program develops space for connection of professional mediators to share and learn from the practice and experience they have been doing.
3. Access to Mediation Service
The program aims to provide multi-access to peaceful and non-violence dispute resolution of civil cases of public and private communities through the informal justice system in particularly ADR and mediation mechanism. The parties in conflict directly use our services without charge and non-discrimination. The program establishes the service office where the trained professional mediators can help the parties with dispute settlement at different levels of conflict such as business contract, commercial issues, disputes at work place, family and domestic violence. The mediation office will apply the procedure, code of conduct, and principles as a guideline for operation of mediation services.
The program strongly commits to provide an effective, cost-saving alternative to traditional methods of resolving disputes and to offer a simple, accessible and inexpensive method of dispute settlement to members of public community, particularly to the poor, women, and disadvantaged populations.
4. Promote and Educate the Public and Government on Mediation
This program intends to promote and raise public awareness of the informal dispute settlement through ADR and mediation approaches in which contributes to legal reform, rule of law and improve public satisfaction with the justice system. The program provides accessible forums to people with disputes and teaches the public to try more effective processes than using violence forces or litigation for settling disputes. The program provides learning and understanding processes, role and function of ADR and mediation mechanism in private dispute settlement. The program promotes and poster the use of non-formal judicial system ADR and mediation means to alternate litigation and better incorporate ADR methods into the formal justice system in Cambodia.
