Mediation: Theory and Practice
I. INTRODUCTION
CCM and Options Mediation began working together in December 2019. CCM asked Options Mediation to collaborate on a project exploring the possibility to support CCM to establish the office of mediation service and train the civil society group, private sector, lawyers, and retired civil servants to become professional mediators who can provide quality mediation service to the civil society and business community in Cambodia.
a. The Cambodian Centre for Mediation
The Cambodian Centre for Mediation “CCM’’ (https://www.ccm-mediation.org/) is a local non-governmental, non-profit and independent organization committed to promoting peaceful and nonviolent solutions and justice in Cambodia through mediation as an alternative dispute resolution “ADR”. CCM is committed to promoting mechanisms for ADR in Cambodia through building the capacity of mediation skills, developing professional mediators within the community, local and international civil society and government, and providing access to self-determination through mediation services to communities and private sectors. The CCM intends to increase the number of mediators for its panel who have diverse backgrounds and experience in peacebuilding, conflict resolution, ADR and mediation practice. The panel will be committed to training newly recruited mediation students. We aim at establishing highly skilled and qualified mediators. This will place CCM as an ADR service provider with high standards, quality of work and ethical service in Cambodia and internationally.
b. Options Mediation Service
Options Mediation Services "OMS'' (https://www.optionsmediation.com.au/), is a professional mediation firm (based in Australia) dedicated to working diligently every step of the way-from pre-mediation calls to post-meditation follow-up. Partnered with several distinguished alternative dispute resolution institutions, Options Mediation offers comprehensive dispute resolution services including professional mediation, arbitration, conflict management coaching, workplace assessment, and conflict management facilitation. Options mediators and arbitrators successfully resolve cases ranging in size, industry, and complexity, typically achieving results more efficiently and cost-effectively than through litigation. Options Mediation neutrals are skilled in ADR processes including mediation, arbitration, special master, discovery referee, project neutral, and dispute review board work.
II. GOAL
The goal is to establish a highly skilled professional panel of mediators and trainers in mediation who will provide professional mediation training recruited by CCM. The new graduates of the training course will be of high quality, highly skilled and qualified to provide a service that meets the needs of conflicting parties at all levels. CCM will also develop mediation Accreditation Standards to ensure that mediators are qualified and adhere to professional and ethical standards. CCM strives to be a leading agency in mediation training and service provider.

The training weave together theory, observation, experiential exercises, and practice opportunities to create a meaningful learning experience. The participants are strongly encouraged to actively participate in field practice and continue learning and developing new skills and techniques of mediation practice. The participants have opportunities to practice the knowledge, skills and experience of mediation learned from the course as a practical mediator in dispute resolution. The participants will explore and evaluate their active knowledge and “theory” of the mediation process, their strengths, and weaknesses as practitioners, and develop ways to revitalize their commitment to mediation practice. The OMTP will be trained by ADR and Mediation Experts and Senior Fellows from CCM, Options Mediation Service (OMS), and Weinstein International Foundation (WIF) who have practical intensive experiences in ADR and mediation practice at national and international levels. The program will study and practice mediation skills and techniques at OMTP as well as at fieldwork by doing mediation exercises and role-plays via Zoom call and participating in observation and co-mediation of real mediation cases at the Office of the Legislation and Local Dispute Mediation ‘’OL&LDM’’ at the government district level and/or the Office of the Santheankam International ‘’OSI’’. The trained participants in mediation will be certified as professional trainers and mediators by OMS and CCM after completing the requirements of CCM’s certification. The training of trainers will work as professional trainers and mediators at OSI.

- Launch the mediation convention with the participation of the Online Mediation Training Program (OMTP) who have a background, experience and strong commitment in ADR and mediation.
- Train and build the capacity of OMTP to be qualified mediators and trainers in mediation.
- Arrange field visits for those core trainers in mediation to observe mediation processes and practices at any chosen dispute resolution office or centre.
- Provide the opportunity for the trainers in mediation and OMTP to apply their mediation skills by co-mediation with experienced mediators.
- Coach the trainees in mediation to enrich their skills in mediation processes and practices.
- Define experiences by specializing experts into specialist mediators (Ex. Family Mediation, Workplace Mediation, Commercial Mediation, Construction, etc.) through the confidence of mediation services.
- Certify qualified the train the trainers in mediation and mediators who have completed the mediation skill training course and mediation practice requirements.
IV. EXPECTED RESULTS
- Participants increased knowledge, skills, and theory of the mediation training program.
- Participants gained concrete mediation skills and techniques.
- Participants gained confidence in providing the training skills in mediation and practising mediation, as well as adopting appropriate ways of addressing conflict resolution in their workplace and community.
- Participants awarded the certified train the trainers in mediation from CCM and Options Mediation.
- Participants become qualified trainers in mediation skills and practice.
- Participants will be able to advance their mediation skills and practice and may become qualified mediators.
V. ELIGIBLE PARTICIPANTS
- CCM and OMS will, initially, recruit 15-20 participants to become the mediation pioneer team.
- OMTP was developed in supporting the Mediation Pioneers in Cambodia to pursue and promote knowledge, skills, and experience of ADR and mediation practice to young people in Cambodia.
- The qualified persons who strongly commit to full 6-day virtual training participation.
- Persons who possess a clear long-term vision and mission to promote ADR and mediation to the civil society, business community and government.
- Persons who possess a concrete goal and plan to use ADR and mediation as a professional job in their careers.
VI. TRAINING METHODOLOGIES

IX. TRAINING REQUIREMENT
The mediation training is developed into two parts, basic mediation for professional and advanced mediation techniques. Although a mediator certificate is not required to practice mediation, CCM sets standards for mediators who work as CCM mediators to provide the communities and business mediation services. The core mediation training program consists of 40 hours as basic mediation process and practice. The 40 hours of basic mediation for professionals is the prerequisite course for participants who pursue the advanced mediation techniques, specific training courses or certify and accredit mediators of CCM. The participants are required to actively participate in all learning processes and different steps of practical work. The participants are expected to participate in exercise and practices of mediation sessions where they are monitored and evaluated by trainers during the training courses. The participants are requested to take part in exercises and role-plays of mediation practice where they take a role as party and mediator of the mediation sessions. Completion of “Basic Mediation for Professional” is the prerequisite course for each certificate. Certificates are issued upon verification of full attendance at all required courses.
X. TRAINING COURSE FEES
The committed participants who attend the mediation training should pay full training fees of $300 per six-day training course (48 hours) for the online training program and materials. When participants are required to participate in field observation and co-mediation sessions, the participants should pay according to actual expenses, for example, accommodation, transportation, food, etc.
XI. APPRENTICESHIP PROGRAM
This program was designed and aims to transfer relevant knowledge, skills, and attitudes within the desired period from expert practitioners in the ADR and mediation field of study or profession to novice trainees who ideally have completed the OMTP. After completing the mediation train course, the participants are required to do an apprenticeship for at least 2 mediation cases and 2 co-mediation cases.
XII. TRAINING AND MEDIATION SERVICES
Once the mediation training course and the training requirements were completed, the mediation trainees who interest to pursue accredited mediation certification should join the professional team to become a trainer and mediator at CCM for at least one year and from the second year on CCM will pay training fees or mediators fees case by case. When a client requested any mediation cases from CCM the participants should participate in preliminary preparation and processes of the training courses or mediation cases before conducting training courses or mediation sessions for our clients. The participants should provide one mediation case per month (twelve cases per year).
